Killeen Daily Herald 2012 “Best
in Show” Annual Pet Contest
Official Rules
1. ALL FEDERAL, STATE,
LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
2. Eligibility. Subject to the
additional restrictions below, the Best In Show Pet
Contest is open to residents of
the United States of America,
18 years or older at the time of entry.
Employees of the Killeen Daily Herald and their immediate family members
of, and any persons domiciled with, are not eligible to enter or to win.
3. How To Enter. Submit a photo of your pet(s) online at www.kdhnews.com/petcontest with
all required information. Photos must be submitted by an adult 18 years or
older. Only one photo per entry per pet. Multiple pets
can be entered as one “pet photo” entry if all the pets are in one photo.
Photos can also be brought to our main offices at 1809 Florence Rd, Killeen,
TX 76540. Owner’s names and phone numbers must be
included with all entries as well as written on the back of each photo. Poor
quality photos will not be accepted.
Include your pet’s name
and the owner’s name, address and phone number. Entry forms can be found online
at www.kdhnews.com/petcontest, and at or in the
Killeen Daily Herald. Entries with incomplete or incorrect information will not
be accepted. Owner information will be verified by phone. Photos will not be
posted until information is verified.
Entry for the contest
will open at 12:00 a.m. (C.S.T) on Thursday, March 1, 2012 and will close at
11:59 p.m. (C.S.T) on Friday, April 13, 2012.
Official voting time for
the contest will begin at 12:00 a.m. (C.S.T) on Sunday, April 1, 2012 and end
at 5:00 p.m. (C.S.T.) on Friday, April 27, 2012. All previously submitted votes from entry forms
will be entered and applied as they are received.
Enter online at www.kdhnews.com/petcontest or by
mailing or delivering the photo of your pet(s) along with the completed entry
form. All photos become the property of Killeen Daily Herald and absolutely no
photos will be returned. Copyrighted photos must be accompanied by
photographer’s release. Killeen Daily Herald reserves the right to refuse any
photograph it determines to be unacceptable. Pet photos will be displayed at www.kdhnews.com/petcontest. A special tabloid insert will
publish in May 2012 featuring all entries with 200 votes or more when voting is
completed. All owners of entrants specifically grant the right to the Killeen
Daily Herald to publish the photo of their pet(s) in the newspaper and online
on the websites of the Killeen Daily Herald.
Voting is open to
everyone – online voting is limited to persons 13 years and older. You can vote
for your favorite pet photo by submitting a voting ballot along with a payment
of $0.25 to Killeen Daily Herald ($0.25 = 1 vote). When voting online or in
person, the minimum number of votes allowed is 20. This is equivalent to $5.00.
Your computer must accept cookies, or any successor or similar technology,
which may be used for the purpose of entry tracking. Ad blocking software on
your computer needs to be disabled so that it doesn’t interfere with processing
your entry.

for free by registering at www.kdhnews.com/petcontest.
The Killeen Daily Herald
and will not be responsible for incomplete, lost, late, postage-due,
misdirected or illegible entries. UPICKEM and Killeen Daily Herald are not
responsible for Internet crashes or slowdowns caused by network congestion,
viruses, sabotage, satellite failures, phone line failures, electrical outages,
natural disasters or acts of man or God. In the event of a dispute, all online
entries will be deemed to have been submitted by the owner of the ISP account
from which they were sent. For these purposes, an ISP account holder shall mean
the natural person assigned to such ISP account by the Internet access
provider, online service provider or other organization responsible for
assigning ISP addresses for the domain associated with such ISP account. All
entries become property of Killeen Daily Herald and none will be returned. Any
questions regarding the number of entries submitted or the owner of an ISP
account shall be determined by the Killeen Daily Herald in its sole discretion,
and the Killeen Daily Herald reserves the right to disqualify any entries by
persons determined to be tampering with or abusing any aspect of the contest.
4. Winner Selection. Winners will be
determined by total votes only. In the event of a tie, the Killeen Daily Herald
will randomly pick the winner from the tied entries. Winners will be first
notified and then announced at www.kdhnews.com/petcontest
on or about Monday, April 30, 2012. Results are not official until winners have been
notified.
5. Winner Notification
and Acceptance. All results posted are unofficial until winners respond to e-mail
notification. Winners will be notified on or about April 30, 2012 at the
telephone number and email address provided on winner’s entry form. Winners
will be notified by email and phone. If a winner is unreachable after seven (7)
days, or if that winner is unavailable for prize fulfillment, an alternate
winner will be selected. If Killeen
Daily Herald cannot find an eligible winner for the prize, that prize will not
be awarded. Winners may waive their right to receive prizes. Prizes are
non-assignable and nontransferable. No substitutions allowed by winner. Prizes
and individual components of prize packages are subject to availability and the
Killeen Daily Herald reserves the right to substitute prizes of equal or
greater value. Winners are solely responsible for reporting and payment of any
taxes on prizes. Winners may be required to complete an affidavit of
eligibility/liability and publicity release (except where prohibited by law)
which must be returned within ten (10) days of date of personal delivery or
date of postmark. Failure to sign and return the affidavit or release within
ten (10) days, or to comply with any term or condition of these Official Rules,
may result in a winner’s disqualification, the forfeiture of his or her
interest in the prize, and the award of the prize to a substitute winner.
Except where prohibited, acceptance of any prize constitutes winner’s consent
to the publication of his or her name, biographical information and likeness in
any media for any commercial or promotional purpose, without limitation the
Internet, or further compensation. Prizes not won and claimed by eligible
winners in accordance with these Official Rules will not be awarded and will
remain the property of the Killeen Daily Herald.
6. Participation. By participating,
entrants agree to be bound by these Official Rules and the decisions of The
Killeen Daily Herald. The Killeen Daily Herald reserves the right to disqualify
persons found tampering with or otherwise abusing any aspect of this contest as
solely determined by the Killeen Daily Herald. In the event the contest is
compromised by a virus, non-authorized human intervention, tampering or other
causes beyond the reasonable control of the Killeen Daily Herald which corrupts
or impairs the administration, security, fairness or proper operation of the
contest, the Killeen Daily Herald reserves the right in its sole discretion to
suspend, modify or terminate the contest. Should the contest be terminated
prior to the stated expiration date, the Killeen Daily Herald reserves the
right to award prizes based on the entries received before the termination
date. Automated voting of any kind is not allowed. Detection of said automated
voting will lead to votes being voided.
Only one registered
account per voter. If multiple accounts are detected for a single voter, they
will be disabled and votes disqualified.
7. Copyright. The Contest and all of
the related pages, contents and code are copyright, UPICKEM, Inc., and/or
Killeen Daily Herald. Copying or unauthorized use of any copyrighted materials,
trademarks or any other intellectual property without the express written consent
of its owner is strictly prohibited.
8. Sponsor Release. Each winner, by
acceptance of the prize, agrees to release all Sponsors, and their parent and
subsidiary companies, their officers, directors, employees, agents,
shareholders, affiliates, suppliers, distributors, and advertising agencies
from all liability, claims, or actions of any kind whatsoever for injuries,
damages, or losses to persons and property which may be sustained in connection
with the receipt, ownership, or use of the prize.
9. Construction. The invalidity or
unenforceability of any provision of these rules shall not affect the validity
or enforceability of any other provision. In the event that any such provision
is determined to be invalid or otherwise unenforceable, these rules shall be
constructed in accordance with their terms as if the invalid or unenforceable
provision was not contained therein.
10. Sponsor. The Killeen Daily Herald
Best In Show Pet Contest is sponsored by the Killeen
Daily Herald. The decisions of the Killeen Daily Herald regarding the selection
of winners and all other aspects of the contest shall be final and binding in
all respects. The Killeen Daily Herald will not be responsible for
typographical, printing or inadvertent errors in these Official Rules or in
other materials relating to the contest. For a list of winners (available after
